Declaração do risco seguro e direito ao esquecimento

Abstract

O presente estudo tem por objeto a articulação entre o regime do dever de declaração inicial do risco no contrato de seguro, estabelecido nos artigos 24.º ss. do Regime Jurídico do Contrato de Seguro, e o do direito ao esquecimento, traçado na Lei n.º 75/2021. O texto apresenta os dois institutos – dando particular nota das dúvidas, incertezas e paradoxos que decorrem deste último –, e desenvolve uma análise crítica sobre a sua concatenação, testando, de forma prática, nas suas várias vertentes, as implicações da tensão entre o dever de informação que incide sobre a pessoa segura e o direito desta a omitir informação clínica no quadro da lei do esquecimento.

The object of this study is the articulation between the duty of disclosure in insurance, ruled under Articles 24 et seq. of the Insurance Contract Law, and the right to be forgotten, set out in Law nr. 75/2021. The text presents the two institutes – paying particular attention to the doubts, uncertainties and paradoxes that arise from the latter – and develops a critical analysis of their concatenation, testing, in a practical way and in various aspects, the implications of the outlined tension between the duty of disclosure that binds the insured person and the latter’s right to omit clinical information within the framework of Law nr. 75/2021.
